Italian Citizenship by Descent
Italian citizenship is based upon the principle of “jus sanguinis” (blood right) meaning that a child born to an Italian father or Italian mother is an Italian citizen regardless of their place of birth. This transfer of citizenship is then passed on to subsequent generations.
In order to be recognized as an Italian citizen, applicants have to prove that their Italian ancestor was not only born in Italy, but did not renounce their Italian citizenship before his son or daughter’s birth in the U.S. or any other country.
Individuals who qualify will apply for citizenship with the Italian consulate that has jurisdiction over their place of residence.
Italian Citizenship by Marriage
Spouses of Italian citizens are entitled to apply for Italian citizenship after 3 years of marriage (2 years if residing in Italy) and attaining a level B1 language proficiency certificate.
Citizenship Through An Italian Female
According to Italian Law, Italian-born women and women of Italian descent could only pass on Italian citizenship to their children if they were born after January 1, 1948. Therefore, children born prior to 1 January 1948 are unable to apply for Italian citizenship through the Italian consulate. However, in 2009 an Italian attorney challenged this law as being discriminatory and the Court of Cassation (Italy’s high court) agreed. Therefore, Italian descendants who fall into this category can now attain Italian citizenship by filing a lawsuit in Italian court.
